                              ORDINANCE NO.   9870 
        
        
                   AN ORDINANCE TO AMEND ORDINANCE NO. 9853,
                   ENCAPTIONED, "AN ORDINANCE TO AMEND ORDINANCE
                   NO. 6958, AS AMENDED, KNOWN AS THE ZONING
                   ORDINANCE, SO AS TO REZONE A TRACT OF LAND
                   LOCATED AT 5113 HIGHWAY 58, BEING ON THE
                   NORTHWEST LINE OF HIGHWAY 58 NORTHEAST OF
                   LANTANA LANE FROM R-1 RESIDENTIAL ZONE, R-2
                   RESIDENTIAL ZONE AND R-4 SPECIAL ZONE TO C-5
                   NEIGHBORHOOD COMMERICAL ZONE, WITH CERTAIN
                   CONDITIONS." SO AS TO CORRECT AN INADVERTENT
                   ERROR IN THE LEGAL DESCRIPTION.

              	   SECTION 1.  WHEREAS, Ordinance No. 9853 contained an
         inadvertent error in the property description of the tract to 
be
         rezoned; and
              	   WHEREAS, the staff of the Chattanooga-Hamilton County
         Regional Planning Commission recommends to the City Council of
         the City of Chattanooga  that said error should be corrected;
        
                                 NOW, THEREFORE,
         	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance No. 9853, encaptioned as 

         set forth above, be and is hereby amended to substitute the
         revised legal description as follows:
                
                
                 A tract of land located at 513 Highway 58, being
                 on the northwest line of Highway 58 northeast of
                 Lantana Lane.  Part of two unplatted tracts,
                 being part of the properties described in deed
                 book 3608, page 639, ROHC, and deed book 3899,
                 page 329, ROHC.  Said parts of tracts form one
                 tract beginning on the northwest line of Highway
                 58 some 587.7 feet northeast of the intersection
                 of the northwest line of Highway 58 with the
                 northeast line of Lantana Lane, thence northwest
                 some 325 feet with the northeast line of United
                 States of America property to a point in said
                 line 200 feet (if measured at a right angle)
                 northwest of the northwest line of Highway 58,
                 thence northeast some 528 feet parallel to, and
                 at all points 200 feet northwest of, the
                 northwest line of Highway 58, thence southeast
                 some 272 feet to the northwest line of Highway
                 58, thence southwest some 435 feet with Highway
                 58 to the point of beginning.  Tax Map No.
                 120K-A-12 and 13.
                                        
                
         	   SECTION 2.  BE IT FURTHER ORDAINED, That Ordinance No.
         9853 shall reamin in full force and effect except as set forth
         above.
         	   SECTION 3.  BE IT FURTHER ORDAINED, that this
         Ordinance shall take effect two weeks from and after its
         passage,  the public welfare requiring it.
